These Terms of Service ("Terms") govern your use of Syfon, an SMS routing service operated by Consilience (consil.co.uk). By using Syfon, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Syfon, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our service.
If you are using Syfon on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Description of Service
Syfon is an SMS routing service that receives SMS messages (typically 2FA verification codes) sent to your dedicated Syfon phone number and routes them to multiple destinations including SMS, email, Slack, Google Chat, Telegram, and webhooks.
We provide you with a dedicated phone number that you can use as the 2FA number for your shared accounts, enabling your team to receive verification codes simultaneously.
3. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring that your use of the service complies with these Terms
- Keeping your account information accurate and up to date
- Properly configuring your routing destinations
You must notify us immediately if you become aware of any unauthorised use of your account.
4. Acceptable Use
You agree not to use Syfon to:
- Send spam, unsolicited messages, or engage in any form of harassment
- Transmit any illegal, harmful, threatening, abusive, or objectionable content
- Violate any applicable laws, regulations, or third-party rights
- Engage in fraudulent activities or impersonate others
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the service or servers connected to it
- Use the service in any manner that could damage, disable, or impair the service
- Reverse engineer, decompile, or disassemble any part of the service
We reserve the right to suspend or terminate your account if we reasonably believe you are violating these Terms.
5. Service Availability
We strive to provide reliable service, but Syfon is provided on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted, error-free, or available at all times.
We may modify, suspend, or discontinue any part of the service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.
Message delivery depends on third-party carriers and services, and we cannot guarantee delivery times or success rates.
6. Fees and Payment
Syfon may be offered as a paid service. Current pricing and payment terms will be provided at the time of registration or subscription. We reserve the right to modify pricing with reasonable notice.
All fees are non-refundable unless otherwise stated or required by applicable law.
7. Intellectual Property
Syfon and its original content, features, and functionality are owned by Consilience and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Consilience and its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or business opportunities
- Service interruptions or delays
- Failed or delayed message delivery
- Unauthorised access to your account
- Any other matter relating to the service
Our total liability for any claims arising from your use of Syfon shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless Consilience and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from your use of the service or violation of these Terms.
10. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your account immediately, without prior notice, if we believe you have violated these Terms.
Upon termination, your right to use the service ceases immediately. Provisions of these Terms that should reasonably survive termination will remain in effect.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date.
Your continued use of Syfon after changes are posted constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of Syfon shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Consilience regarding your use of Syfon and supersede any prior agreements.
